Terms of Sale - Highlights

The following highlights key sale terms and identifies sale specific terms. These, along with our General Terms & Conditions of Sale and any announcements made prior to the auction, comprise the Complete Terms of Sale between ThreeSixty Asset Advisors as Auctioneer, along with its partners, advisors and clients, and you as Bidder or Buyer. NOTE: Terms are subject to modification; please verify terms prior to bidding. All references to Auctioneer encompass ThreeSixty Asset Advisors, its partners, bidding platforms, agents and representatives.

 

  • BUYER’S PREMIUM: A 16% Buyer’s Premium will be added to the price of each lot.
  • DEPOSITS: Credit cards are requested at the time of registration to assist with our buyer qualification process. However, cards are not charged unless and until you make purchases and in alignment with all other terms of sale. Upon placing a bid at the auction, you acknowledge and accept that by doing so, you accept all terms of sale including your immediate obligation to a 25% deposit on winning bids. Please note that this obligation remains whether or not we elect to charge the deposit or await full payment at the conclusion of the sale. Bidders intending to spend in excess of $5,000 or International Bidders must contact Auctioneer prior to the Sale to make arrangements, which may include providing a cash form of deposit (i.e. wire transfer), at Auctioneer’s sole discretion, to authorize your participation and avoid bidding interruption.
  • PAYMENT DEADLINE: All payments are due upon receipt of Invoice, which will be emailed within 24 hours of the auction. If you were a successful bidder and do not receive an invoice within 24 hours of the auction, please contact the Sales Team. Payments must be made prior to picking up your purchases.
  • PAYMENT FORMS: For all invoices up to $5,000 (total including fees), your credit card on file will be charged upon the completion of the sale, subject to a 3% convenience fee. If you prefer not to pay by credit card, or if you spend in excess of $5,000, contact our office for wire transfer instructions. All wires must be received by close of business (5:00 PM Pacific) on the day following the auction. We do not accept ACH payments. The auction is being conducted in United States Dollars ($USD).
  • SALES TAX: Sales tax is assessed based on where the goods are located (see each lot for its location), and based on the purchase price plus buyers’ premium. Sales tax will only be waived upon receipt of a valid reseller permit from Buyer acceptable to the taxable jurisdiction, provided PRIOR TO THE CLOSE OF THE AUCTION. Note that out of state resale certificates are not accepted by California for exemption.
  • BIDDING: Items will close at a rate of 2 items per minute and will extend when any bidding occurs within 2 minutes of the closing or any adjusted closing time. Bidding occurs per the increment table accessible on the bidding website. You may review the bid history on an item at any time. Note that if a high bid equal to your high bid is awarded to another bidder, this means they submitted a maximum bid for the same amount prior to your bid submittal.
  • QUANTITIES: Please note that some lots may have multiple pieces. Note if the bid system shows “x” the bid, then the bid price you submit will be multiplied by the unit. Otherwise, your bid will be a lump sum for the entire lot, inclusive of the entire quantity described. Please review the specific lot offering to ensure proper bidding, as bids may not be retracted once submitted.
  • CONDITION: Every lot states a Condition classification. See the Condition Classifications section below for what each one means. Condition classifications are offered as a guide and are not a warranty or guarantee of operability.
  • WARRANTY: Many lots are offered with a warranty provided by the manufacturer or the seller of the particular item, and not by Auctioneer. See the Warranty Information and Limitations section below for the types offered, what they cover, and how to make a claim.
  • PICKUP/SHIPPING: Shipping is NOT provided by Auctioneer. However, we have obtained competitive flat rate shipping options which can be coordinated and paid for directly with [email protected]. Such shipping prices are based on a $30 per parcel or $350 per pallet rate as further noted on each lot. Note that flat rate shipping is capped at a maximum total of $7,500 for all lots purchased. All pickup and shipping arrangements must be made within one week of the auction closing.
  • REPRESENTATIONS: We do our best to help Buyers make informed purchase decisions. All information provided, including condition, descriptions, photos, part numbers, and spec sheets, is offered as a guide, in good faith, and with the utmost care. However, we cannot guarantee the accuracy of any such information and do not warrant the sale of any item on the grounds of inaccuracies, inconsistencies, or otherwise. All warranties listed are provided, as indicated, by either the product manufacturer or the seller of the particular item. In certain cases, manufacturers’ standard warranties may still be in effect. Neither ThreeSixty Asset Advisors nor TekX is offering, or is responsible for providing, facilitating, or otherwise handling, warranty-related claims. As a courtesy, TekX will act as the initial single point of contact for any warranty claim that may arise and will direct you to the appropriate party. Announcements made on auction day take precedence over published information. All Items are sold ‘As-Is, Where-Is’, with all faults and without recourse. Buyer assumes all risks, all sales are final and under no circumstances will any claims be considered once purchases are removed from the sale site. Some items – as noted in the lots – may be sold subject to reserve or post sale Seller Approval.
  • BIDDING DISCLAIMER: Auctioneer reserves the right to add, delete or combine lots, as well as adjust closing times, bid extensions or add or remove reserve prices. The auction relies on third party systems and technology that may be subject to connection interference and other systems failures. Auctioneer reserves the right to take such actions it deems appropriate and fair to resolve bidding issues as a result of such technology issues or human error.
  • DEFAULT: Upon award of bid, Buyers are deemed responsible for a non-refundable 25% deposit. In the event of a Buyer default, Buyer’s acceptance of these Terms of Sale, evidenced by their participation in the auction, shall serve as Buyer’s authorization for Auctioneer to pursue whatever means necessary to collect upon the 25% deposit as liquidated damages, including charging its credit card on file, and/or pursue resale of the items on the invoice.

Condition Classifications

Every lot in this sale states a Condition. Use these definitions to set your expectations before you bid. Any known issues specific to a lot are disclosed in that lot’s description.

 

  • New: Unused and in new condition. Original packaging may have been opened or may not be included. Warranty, if any, is listed separately.
  • B-Stock: Open-box, demonstration, customer-returned, refurbished, or surplus equipment not represented as factory-new. Packaging differences, prior handling, or minor cosmetic wear may be present. Functional status is as stated in the lot description.
  • Excellent: Tested and fully functional with little to no visible wear.
  • Good: Tested and fully functional with normal signs of prior use, such as minor scratches, scuffs, or handling wear.
  • Fair: Functional, but with noticeable cosmetic wear and/or minor defects that do not prevent its intended use. Known issues will be disclosed in the lot description.
  • Poor: Significant wear, damage, or functional limitations are present. The item may require repair, service, or replacement components.
  • Parts Only: Nonfunctional, incomplete, heavily damaged, or intended for parts, salvage, or repair. No functional use should be expected in its current condition.
  • Unknown / Not Tested: Operating condition has not been verified. The item may be fully functional, partially functional, or nonfunctional.

Condition classifications are offered as a guide only. They reflect a general assessment and are not a warranty or guarantee of condition, completeness, operability or fitness, and they do not create any obligation of ThreeSixty Asset Advisors or TekX.

All items are sold ‘As-Is, Where-Is’, with all faults and without recourse. Photographs, descriptions, specs, and stated conditions are offered as a guide, in good faith, and with the utmost care, but accuracy is not guaranteed. If you are uncertain about a lot, do not bid.

Warranty Information and Limitations

Where applicable, certain lots note that product is sold with warranty. Those lots also state the warranty type and the period of time it applies.

 

Warranty Types

  • Full Manufacturer’s Warranty: Includes the manufacturer’s full standard warranty, subject to the manufacturer’s eligibility, registration, transferability, and coverage terms.
  • Remaining Manufacturer’s Warranty: Includes the unexpired portion of the original manufacturer’s warranty, subject to the manufacturer’s transferability and coverage terms.
  • Seller Replacement Warranty: The seller will replace the item if a verified covered defect is reported within the stated warranty period. Replacement may be the same or a comparable item.
  • Seller Repair Warranty: The seller will repair a verified covered defect reported within the stated warranty period, subject to the stated coverage and claim terms.
  • Seller Full / Partial Refund Warranty: The seller will provide a full or partial refund for a verified covered issue reported within the stated warranty period. The refund amount and any return requirements will depend on the issue and the seller’s stated terms.
  • Seller Inspection Period Warranty: The buyer has a stated period after pickup or delivery to inspect and test the item and report a material, undisclosed problem. After the inspection period expires, the item is accepted as-is and no further warranty applies.
  • No Warranty: Sold as-is, where-is, with all faults. No warranty or post-sale remedy is provided except as required by applicable law or the auction terms.

What is covered: Any applicable warranty is intended to cover a material defect or condition that is inconsistent with the information, photographs, testing results, and disclosures presented in the auction listing, provided the equipment has remained in substantially the same condition as when it left the seller’s possession.

What is not covered: Warranty coverage generally does not apply to damage, failure, or deterioration resulting from shipping or handling, improper installation, misuse, abuse, neglect, accident, improper storage, unsuitable power or environmental conditions, unauthorized repair or modification, failure to follow manufacturer instructions, or other actions or omissions occurring after the equipment leaves the seller’s dock, whether intentional or unintentional. If the equipment is not in substantially the same condition as when it left the seller’s possession, coverage may be denied. Eligibility and the appropriate remedy will be determined by the seller in its reasonable discretion based on the available evidence and the specific circumstances of the claim.

Who provides it: All warranties listed are provided, as indicated, by either the product manufacturer or the seller of the particular item. In certain cases, manufacturers’ standard warranties may still be in effect. Neither ThreeSixty Asset Advisors nor TekX is offering, or is responsible for providing, facilitating, or otherwise handling, warranty-related claims. Neither is a party to any warranty, and all claims must be made with and resolved by the provider of the warranty. As a courtesy, TekX will act as the initial single point of contact for any warranty claim that may arise and will direct you to the appropriate party. Warranty-related questions, issues, or concerns can be directed to [email protected].

Items remain As-Is: Regardless of any warranty offered or condition stated, all items are sold ‘As-Is, Where-Is’, with all faults and without recourse. The existence of a warranty on a lot does not alter the As-Is, Where-Is nature of the sale, does not extend to any other lot, and does not modify any other term of sale. Condition classifications and warranty types are offered as a guide to help you bid; they are not a guarantee of operability, completeness or fitness, and they do not create any obligation of ThreeSixty Asset Advisors or TekX.

Payments

  • Following the auction, your credit card on file will be charged for the balance of your purchases, including sales tax, unless you have notified us by email prior to the sale closing of your intent to pay by wire transfer. Credit cards are subject to a 3% convenience fee.
  • Buyers whose credit cards are successfully charged will receive a paid invoice by email following the auction.
  • Buyers with a balance due after the auction will receive a balance due invoice following the auction, due immediately.
  • Buyers electing to pay by wire transfer must contact our office for wire transfer instructions at 1-805-496-8087, ext. 110.
  • Payments are not accepted at the Auction Site.
  • Balances in excess of $5,000 must be settled by wire transfer.
  • We do not accept ACH payments. The auction is being conducted in United States Dollars ($USD).
  • All balances due must be received by close of business (5:00 PM Pacific) on the day following the auction.
  • Payment must be made prior to picking up your purchases.
  • Sales tax exemption forms must be provided PRIOR TO THE CLOSE OF THE AUCTION and can be emailed to [email protected].

Pickup/Shipping

This is a multi-seller, multi-location sale. Lots are warehoused at sites across the United States, and the location is noted on every lot. Check it before you bid.

 

Pickup Scheduling

  • Following the auction, contact [email protected] to coordinate your pickup or shipping.
  • All pickup and shipping arrangements must be made within one week of the auction closing.
  • Whether you choose to take advantage of the flat rate shipping option, use your own shipper, or arrange pickup from each location, all coordination will take place through [email protected].
  • Items are deemed accepted upon payment at their warehoused location. Buyer is responsible for all shipping and insurance costs.
  • Any third party picking up on a Buyer’s behalf must be authorized via the Agent Release form: https://360bid.short.gy/agent_release
  • Shipping is NOT provided by Auctioneer.

Optional Flat Rate Shipping

  • We have obtained competitive flat rate shipping options which can be coordinated and paid for directly with [email protected], as a separate transaction from your auction invoice.
  • Such shipping prices are based on a $30 per parcel or $350 per pallet rate as further noted on each lot. Note that flat rate shipping is capped at a maximum total of $7,500 for all lots purchased, regardless of quantity, size, cost, or origin location.
  • Flat rate shipping prices and cap apply to domestic shipments only. International shipments will be quoted and paid for separately at the conclusion of the sale, and may require additional costs to be paid directly (i.e. import/export, tariffs, etc.).

Shipping Insurance and Risk of Loss

  • All shipments must be insured for the equipment’s full purchase value. Damage or loss occurring while in the possession of a carrier is not covered by the seller’s warranty and must be addressed through the carrier or shipment insurer.
  • If the buyer declines, limits, or otherwise fails to obtain full-value shipping insurance, the shipment will travel entirely at the buyer’s risk of loss or damage.
