All Product is being sold by the Pallet and based solely on the pdf inventory reports to be posted in each lot. There will be no onsite inspection for this sale and all sales are final. Product inventories and stated quantities and conditions are all based on company records and have been spotted checked for accuracy. No material discrepancies have been found but cannot be guaranteed. Bid accordingly. Inventory is almost entirely noted as new product but may vary or be open box or bulk packaged. . The following highlights key sale terms and identifies sale specific terms. These, along with our General Terms & Conditions of Sale comprise the Complete Terms of Sale. - INSPECTION: No onsite inspection for this sale; See important terms below about Inventory Pallet Representations.
- DEPOSITS: Upon bid, you are immediately responsible for 25% of your purchases. This obligation persists whether or not the funds are collected. We reserve the right to authorize your credit card for $500 as an initial Auction Registration deposit and to increase the deposit to equal 25% of your total high bids. Bidders intending to spend in excess of $10,000 or International Bidders must make arrangements to provide a cash form of deposit (i.e. Wire Transfer) prior to the Sale to avoid bidding interruption;
- PAYMENT DEADLINE: All payments are due by upon receipt of Invoice and no later than 5:00 pm on the day following the auction;
- PAYMENT FORMS: Payments may be made by credit card (up to $5,000), or wire transfer only. Invoices under $5,000 will be provided with a link to pay by credit card. Credit card payments are subject to a 4% surcharge. If you prefer to pay by wire transfer, please email [email protected].
- BUYER’S PREMIUM: An 18% Buyer’s Premium will be added to the price of each item.
- SALES TAX: Sales tax will be assessed on the purchase price plus buyers’ premium applicable to the jurisdiction where the assets are located, unless you provide evidence of sales tax exemption in accordance with state requirements, acceptable to ThreeSixty, prior to the close of the Auction. Sale Specific Note: California does not accept out of state reseller’s permits but will accept a Bill of Lading from a common carrier shipper showing product is shipped directly out of state from the auction location. Bill of Ladings must be received prior to product pickup.
- REPRESENTATIONS: We do our best to provide information that will help Buyers to make purchase decisions; however we do not guarantee descriptions or conditions. Further, neither Auctioneer or Seller makes any representation, guarantee or warranty as to the provenance, authenticity or operability of any items offered for sale, or the conveyance of any third party rights, including but not limited to copyrights or licensure. Photographs occasionally capture items not intended; if an item is not stated in a lot description, assume it is not included. If you are uncertain about a lot, do not bid. All Items are sold ‘As-Is, Where-Is’, with all faults and without recourse. Buyer assumes all risks, all sales are final and under no circumstances will any claims will be considered once purchases are removed from the sale site.
Important Notes About Inventory Pallet Representations — Please Read Carefully
Neither ThreeSixty nor the Assignee have conducted a physical inventory to confirm the contents of each pallet. All inventory reports were per the company’s records prior to the assignment. ThreeSixty has conducted spot checks and found no material discrepancies. ThreeSixty nor the Assignee guarantees the accuracy of these reports. Please bid accordingly. Buyers may request to validate pallet contents after the auction but prior to removal only for the purpose of price adjustment per the following, not bid retraction, under the following terms:
- All validations must occur before the pallet leaves the premises.
- Any adjustment will be calculated on a total-value basis only — comparing the overall stated value to the auction sale price. No weighting for individual product types or SKUs will be applied.
- An adjustment will only be made if the discrepancy exceeds 5% between the reported and actual total value.
- If the actual value is higher than reported, the buyer agrees to pay the difference based on the same pro rata formula.
- If no shortage is found, a $35 per-lot validation convenience fee will be assessed and must be paid before removal.
- You must notify us at the time you schedule your checkout appointment if you intend to verify inventory pallets as space will need to be coordinated.
- REMOVAL: Buyers are responsible to make arrangements for items to be removed during posted times. All removal is by APPOINTMENT ONLY. Paid Buyers can schedule appointments by emailing your preferred pickup time to [email protected]. Note that we will accommodate requests based on time slot availability. Buyers arriving without an appointment will be accommodated on an ‘as available’ basis or may be turned away. For assistance with shipping, please see our list of unaffiliated, 3rd party shippers noted under “ITEM PICKUP” below. Pallets will be loaded onto buyer’s truck by the 3PL facility. If you intend to do any inventory checks, you must contact us prior as special arrangements will need to be made for you to access the pallet prior to removal. IMPORTANT: Buyers must arrive with an ID that matches the name on the invoice. If sending a 3rd party to pickup on your behalf, you must complete and submit an Agent Release form to our office authorizing the 3rd party to pickup on your behalf. The 3rd party must provide ID matching the Agent Release form and sign documentation upon arrival at pickup.
- REMOVAL TIMES:
- We will NOT be open on the day of or day following the auction.
- We will schedule appointments on the following days and times:
- Thursday & Friday, August 14 & 15
- Monday & Tuesday, August 18 & 19
- From 9am to 4pm
- Thursday & Friday, August 14 & 15
- If you intend to spot check pallets, you must make advance arrangements.
- INSURANCE REQUIREMENTS: Movers/Shipping companies picking up on behalf of buyers or any buyer removing installed items requiring dismantling, rigging, utility disconnection, etc., will need to provide a Certificate of Insurance with the following limits: General Liability 1M per occurrence / 2M aggregate; Umbrella 2M per occurrence / 2M aggregate; Auto 1M (owned/non-owned/hired); Workman’s Compensation Liability at statutory limits. Certificates of Insurance should be brought onsite.

- Invoices will be sent following the auction and are due immediately upon receipt;
- Payments may be made by credit card (up to $5,000), or wire transfer only. Invoices under $5,000 will be provided with a link to pay by credit card. - Upon payment in full, you will receive a paid invoice by email to bring to checkout.

Pickup Scheduling: Buyers are responsible to make arrangements for items to be removed during posted times. All removal is by APPOINTMENT ONLY. Paid Buyers can schedule appointments with the facility direct upon payment (contact information will be provided on paid invoices). Buyers arriving without an appointment will be accommodated on an ‘as available’ basis or may be turned away. Appointment can be scheduled during the following dates and times:

Buyers must bring all materials, carts and manpower necessary to remove their purchases from where the items sit; we do not offer any loading or shipping services. IMPORTANT: Buyers must arrive with an ID that matches the name on the invoice. If sending a 3rd party to pickup on your behalf, you must complete and submit an Agent Release form to our office authorizing the 3rd party to pickup on your behalf. The 3rd party must provide ID matching the Agent Release form and sign documentation upon arrival at pickup.
